Strauss-Kahn lawyers hold meeting with prosecution

Dominique Strauss-Kahn’s lawyers had what they described as a “productive” meeting Wednesday with the Manhattan District Attorney as the case against the former IMF chief appeared to be falling apart. Neither side revealed what was discussed.

AP - Dominique Strauss-Kahn’s lawyers and prosecutors met behind closed doors Wednesday for what defense lawyers called a productive meeting, but there was no immediate word on what would happen to a sexual assault case that has foundered on doubts about the accuser’s credibility.

Strauss-Kahn lawyers Benjamin Brafman and William W. Taylor said the roughly 90-minute, closed-door session with Manhattan District Attorney Cyrus R. Vance Jr. and assistant prosecutors was constructive. Vance’s office wouldn’t comment on the discussion.

“The investigative process is continuing, and no decisions have been made,” spokeswoman Erin Duggan said.

For now, the former International Monetary Fund leader remains charged with trying to rape a maid who came to clean his New York hotel suite.

Meanwhile, the Paris prosecutor’s office said Wednesday it had received a criminal complaint accusing Strauss-Kahn of attempting to rape a writer eight years ago.

He denies both allegations. His lawyers are pushing prosecutors to drop the New York case. They have said they would be able to prove the encounter was not forcible. Just a few weeks ago, it looked destined to be a long legal fight.

Physical evidence linked Strauss-Kahn to the hotel maid accusing him of sexual assault. Her version of events was unwavering, and police and prosecutors called her credible.

Now, prosecutors are rethinking whether they can even go forward with the case after finding that the woman wasn’t truthful about her background and the aftermath of the alleged attack.

They haven’t questioned her account of the encounter itself, at least publicly, but they appear to have lost faith in the accuser’s prospects of helping them prove it.

Authorities haven’t concluded that no attack happened, but amid the revelations about the accuser’s past lies, “the details are a bit more in doubt,” said a law enforcement official who spoke to The Associated Press on condition of anonymity to discuss internal decision-making.

DA Letter to DSK Lawyers

The woman’s lawyer, Kenneth Thompson, has said she’s made mistakes in her life but is telling the truth about her encounter with Strauss-Kahn. He’s urging prosecutors to go forward with the case.

In Paris, the official receipt of the complaint from novelist Tristane Banon means prosecutors must now decide whether there is enough evidence to charge Strauss-Kahn in France.

Banon says Strauss-Kahn tried to rape her in an empty apartment during an interview for a book project, struggling with her on the floor as he tried to tear off her clothes. His lawyers have described the account as “imaginary” and say they plan to file a complaint accusing Banon of slander.

Her complaint faces a series of difficult tests in the French justice system and could be dismissed long before reaching trial. Prosecutors must decide first if her allegations would support a charge of attempted rape rather than the less serious crime of sexual aggression, an attack that does not involve an attempt to penetrate the victim.

Having a Constitution, Law &

Having a Constitution, Law & Judiciary or an Administration with elected representatives at the national or international level is no guarantee that your safety, security and dignity would be vouched. But how does it look like when the victim of allegation happens to be a foreign national, getting caught up with the ignominious scourge of an undeserved legal process, having to rub shoulders with law which apparently is berserk and trounces the victim to depths of a nightmarish house arrest, because the allegation was flung by a female whose bonafides the law has not taken care to verify? Here one definitely needs to take a closer look at the trustworthiness of Law and Judiciary of that particular country!

Unfortunately, we live in a world of unscrupulous and miscreant elements, who through sheer grit and determination, manage to manipulate or exploit circumstances and laws to suit their convenience and come out unscathed despite being on the wrong side of law. Incidentally, many of the laws that have been hastily framed to gratify the electorate or the masses, or even to buy time, invariably favor those very miscreants who habitually defy law or utilize it for their own benefit.

Whatever the logic one may adduce, failure to uphold man’s dignity or to ensure security of individuals would amount to gross failure on the part of law and judiciary or the administration, which directly reflect on the effectiveness and foolproof aspect of Law, the Administration and Constitutional set up of that particular country.

In the present instance, a low graded intruder maid flings a calculated allegation of sexual assault on a high profile dignitary namely Dominic Strauss Kahn, who was rightfully within his suit premises by virtue of his dignity and capacity and was made a victim to lose his job, dignity, aspirations and a world of renown. By no stretch of imagination could an elderly gentleman of such high caliber ever have made undue advance towards a servant of meager reputation without being enticed by the maid to take advantage of a moment of solitude.

But even without necessary enquiry or deterrents, the Law & Judiciary swung in to action provoking a volley of accusations against an unsuspecting person, read Dominic Strauss Kahn, who certainly was not only innocent but betrayed by the maid for personal gains.

Had it not been for the support of people who worked day in and day out to unfold the actual worth and character of the maid, this high profile person who would have been contesting for the top slot in France, would have been languishing under house arrest with the media and public focusing their ire and calumny against him for acts that he might not have even committed.

Does this augur well for Law and Judiciary – that too in a Nation which calls itself a Super Power? Or is it a case of taking undue advantage by the same Super Power merely because the person – a victim of allegation – hailed from a country away from his motherland? A big poser for the Super Power! For a brief period we may not rake up the treachery, if any, by his own political adversaries back at home – just a poser and a pause for now!
